Associationshall mean and refer to the Lake Joseph Homeowner's Association, Inc., a New York Not-for-Profit corporation
Boardshall mean and refer to the Board of Directions of the Association
By-Lawsshall mean and refer to the code or code of rules adopted for the regulation or management of the affairs of the Association irrespective of the of the name or names by which such rules are designated as the same may be amended from time to time.
Owner shall mean and refer to the record owner of any lot. Every lot Owner shall be treated for all purposes as a single owner for each lot held, irrespective of whether said ownership is joint, in common, or tenancy by the entirety. Majority vote of the owners shall be necessary to cast any vote to which said owners are entitled.
The Properties shall mean and refer to the certain real property, both lots and Common Areas, as are subject to this Declaration and which are described in Exhibit A.
Common Areas shall mean and refer to those areas of land to be owned by the Association, which are described in Exhibit B attached hereto as Exhibit B. Said areas are intended to be devoted to the common use and enjoyment by the members of the Association as herein defined, and are not dedicated for use by the general public.
Lots shall mean and refer to any plot of land intended and subdivided for residential use, shown upon the filed subdivision map of the properties, but shall not included Common Areas as herein defined.
Declarant shall mean and refer to LAKE JOSEPH DEVELOPMENT CORP or its assigns and/or successors.
Declaration shall mean and refer to this Declaration of Protective Covenants and any amendments hereto.
Developer shall mean and refer to LAKE JOSEPH DEVELOPMENT CORP, its assigns and/or subscribers.
Development Period shall mean and refer to the period from the date of this Declaration until all lots are sold.
Member shall mean and refer to all those owners who are members of the Association as provided in Article III, Section 2, hereof.
Below are the definition of terms in the Declaration of Covenants, Restrictions, Easements, Charges and Liens contained in the Offering Plan issued by the Developer, the LAKE JOSEPH DEVELOPMENT CORPORATION, on April 10, 1982. Plan is currently on file at the NY Attorney General's Office and recorded in the Office of the Clerk of Sullivan County.
